Estate Planning and Probate

Estate Planning is something a lot of people don’t like to think about. People don’t want to think about dying and what will happen after they pass. However, estate planning is important in ensuring that your financial and health care needs are taken care of if you are unable take care of them yourself, that assets are left to the individuals you want, and that your minor children are cared for by the individual(s) of your choosing.    

Some of the most common documents drafted in estate planning are a Last Will and Testament, a Durable Power of Attorney, and advanced directives, such as a Living Will, and a Health Care Power of Attorney. Each of these documents serves a certain purpose and can help insure that you receive the health care you desire and that your assets are distributed per your wishes.

With Estate Planning often comes Probate. Probate is the administration of your Last Will and Testament and the process in which your debts are paid and assets distributed.
